1. Agreement to Terms

By accessing or using the FoodLens mobile application and services ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms apply to all users of the Service, including visitors, registered users, and subscribers.

2. Description of Service

FoodLens is a nutrition tracking application that uses artificial intelligence to analyze food photos and provide nutritional information. The Service includes features such as meal logging, calorie tracking, nutritional analytics, and personalized recommendations. The Service is provided on a subscription basis with optional free trial periods.

3. User Accounts

3.1 Account Creation

To use the Service, you must create an account. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your password
  • Be responsible for all activity under your account
  • Notify us immediately of any unauthorized access
  • Not share your account with others

3.2 Eligibility

You must be at least 13 years old to use the Service. Users under 18 must have parental or guardian consent. By using the Service, you represent that you meet these requirements.

4. Subscription and Payment

4.1 Subscription Plans

FoodLens offers monthly and annual subscription plans. Pricing is displayed in the app and on our website. We reserve the right to modify pricing with 30 days notice to existing subscribers.

4.2 Free Trial

New users may be eligible for a 7-day free trial. You will not be charged during the trial period. If you do not cancel before the trial ends, you will automatically be charged for your selected subscription plan.

4.3 Billing and Renewal

Subscriptions automatically renew unless canceled:

  • Monthly subscriptions renew every month
  • Annual subscriptions renew every year
  • You will be charged at the beginning of each billing cycle
  • Payment is processed through the App Store or payment processor

4.4 Cancellation and Refunds

You may cancel your subscription at any time through your account settings or the App Store. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial subscription periods, except as required by law or at our sole discretion.

5. User Content and Conduct

5.1 Your Content

You retain ownership of photos, meal logs, and other content you submit to the Service. By submitting content, you grant us a worldwide, non-exclusive license to use, store, and process your content to provide and improve the Service.

5.2 Prohibited Conduct

You agree not to:

  • Upload inappropriate or offensive content
  • Violate any laws or regulations
  • Infringe on intellectual property rights
  • Attempt to reverse engineer the Service
  • Use the Service for commercial purposes without permission
  • Transmit viruses or malicious code
  • Harass or harm other users
  • Create fake accounts or impersonate others

6. Intellectual Property Rights

The Service and its original content, features, and functionality are owned by FoodLens and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without our prior written consent.

7. Medical Disclaimer

IMPORTANT: FoodLens is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease. The nutritional information and recommendations provided by the Service are for informational purposes only and should not be considered medical advice.

  • Always consult with a healthcare professional before making dietary changes
  • Do not rely solely on the Service for medical decisions
  • Nutritional data may contain inaccuracies
  • Results may vary and are not guaranteed

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FOODLENS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

9. Warranty Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Indemnification

You agree to indemnify and hold harmless FoodLens, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service or violation of these Terms.

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including violation of these Terms. Upon termination, your right to use the Service will cease immediately. You may terminate your account at any time by contacting us or through the app settings.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts located in San Francisco County, California.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
